Pikura - Terms of Service

1. Acceptance of Terms

By downloading, installing, or using Pikura ("the App"), you agree to these Terms of Service. If you are a parent or guardian, you agree on behalf of your child. If you do not agree, please do not use the App.

2. Description of Service

Pikura is a creative drawing and coloring application for children and adults. It has three profiles, chosen during setup and changeable later in the Parent Zone: Mini (ages 3-5), Junior (ages 6-11) and Adult. Junior and Adult use the full set of tools. The Adult profile skips the parental gate and receives ads as described in section 5; choosing it requires passing the parental gate once, so a child cannot select it alone. The App provides drawing tools, coloring pages, guided drawing lessons, and a photo-to-coloring feature. Photos used by the photo-to-coloring feature are processed entirely on the device and are never uploaded. Parents or guardians should supervise young children when they use the App.

3. Privacy

Drawings, photos, preferences and progress are stored only on the device and are not sent to our servers. The App does use a few third-party services, including Google AdMob for optional ads, Google Firebase and Qonversion, which receive technical data such as the IP address and device information. Our Privacy Policy lists these services and the data they receive, and its section 6 (Parents and Children) explains the choices available to parents.

4. In-App Purchases

The App offers optional premium subscriptions ("Pikura Plus") that provide access to additional content and features. In the child profiles (Mini and Junior), all purchases require parental verification through a parental gate; the Adult profile skips the gate. Subscriptions are purchased, billed, renewed and canceled through the Apple App Store or Google Play Store under that store's terms, and refunds are handled by the store.

5. Advertising

The free version of the App shows only optional rewarded video ads, provided by Google AdMob. An ad plays only when a user chooses to watch one, for example to unlock one extra photo-to-coloring use for the day. The App does not show banner ads or interstitial (full-screen pop-up) ads, and ads are limited to content rated suitable for general audiences. Where the law requires it (for example in the European Economic Area and the United Kingdom), Google's consent form is shown before any ad is requested. Depending on the choices made there and on local law, Google may use data such as the IP address and device information to show and personalize ads, as described in our Privacy Policy. Pikura Plus subscribers see no ads. In the child profiles (Mini and Junior), no consent form is shown, ad requests are tagged for child-directed treatment and as coming from users under the age of consent, and ads are never personalized; the consent form and possible personalization described above apply only to the Adult profile. On iOS, ads are not personalized in any profile.

6. Content and Intellectual Property

Your creations belong to you. Drawings and other artwork that you or your child create in the App belong to you or your child. We do not claim ownership of them and, because they are stored only on your device, we do not see them. You may keep, print and share your own creations for personal, non-commercial purposes, including artwork made from the App's coloring pages or lessons.

The App itself, including its software, AI models and model weights, coloring pages, lessons, illustrations, mascots, sounds, music and user interface, is owned by or licensed to NTVTech and is protected by copyright and other intellectual property laws. Some components are used under open-source or public-domain licenses (see section 8).

Subject to these Terms, NTVTech grants you a limited, personal, non-exclusive, non-transferable and revocable license to use the App and its content for personal, non-commercial purposes, within the App only, and in accordance with the rules of the store from which you downloaded it. All rights not expressly granted are reserved.

7. Prohibited Uses

You agree not to do any of the following, and not to help or allow anyone else to do so:

• reverse engineer, decompile or disassemble the App, or attempt to derive its source code, except to the extent that applicable law expressly permits this despite this restriction;
• extract, copy or reuse the App's AI models, model weights, coloring pages, lessons, illustrations, mascots, sounds or other assets or content outside the App;
• redistribute, sell, rent, sublicense or otherwise use the App or its content for any commercial purpose;
• circumvent, disable or interfere with the parental gate, the subscription or purchase protections, or any other security feature of the App;
• access or use the App through bots, scripts or any other automated means;
• use the App in breach of applicable law or of the use restrictions of the third-party licenses described in section 8.

If you breach this section, the license granted to you under these Terms ends automatically, and NTVTech may seek any remedies available under applicable law. This section does not limit any rights you have under the open-source licenses of individual components.

8. Third-Party Components and Licenses

The App includes open-source software and other third-party components, which are used under their own licenses. The main ones are:

• Flutter and Dart packages (BSD-3-Clause, MIT, Apache License 2.0 and other open-source licenses)
• Informative Drawings line-drawing model by Caroline Chan et al. (MIT); Pikura's own line-drawing models are derived from it
• MediaPipe Selfie Multiclass Segmentation and Face Landmarker models by Google (Apache License 2.0)
• YuNet face detection model from OpenCV Zoo (MIT)
• MTEED line model by TheMisto.ai (CreativeML Open RAIL++-M, which includes use-based restrictions)
• Nunito, Mali, Baloo 2, Comfortaa and Noto Sans CJK fonts (SIL Open Font License 1.1)
• flag-icons (MIT)
• Background music for drawing replays (CC0 1.0, public domain)

The full license texts and copyright notices are available in the App under Parent Zone > About Pikura > Open-source licenses. Those licenses govern the respective components. Their authors do not endorse Pikura.

We may update these Terms from time to time. Continued use of the App after changes constitutes acceptance.
